Other Things to Know About Becoming a Surrogate in Kansas City

Surrogacy Laws and Legal Professionals

When it comes to surrogacy in Kansas City, you need to be sure you’re going about the process legally within the city, and some of the process may be affected by which side of the state line you’re living on, as Kansas City Kansas and Kansas City Missouri are governed by respective state laws.

In Kansas, there is no law that specifically prohibits or permits surrogacy. But the courts in the state usually grant a pre-birth parentage order to an intended parent who is genetically related to the child.

If the intended parent isn’t genetically related to the child but is married to the genetic intended parent, then that intended parent must complete a stepparent adoption to secure their parental rights.

Unmarried non-genetic intended parents will have to complete a post-birth adoption outside the state.

In Missouri, there is no law that specifically prohibits or permits surrogacy either. But a parentage order may be filed before delivery and will become effective after the child is born.

These post-birth others are usually for single intended parents or married intended parents when one of the intended parents is genetically related.

For same-sex, unmarried couples or when neither intended parent is genetically related to the child, it is still possible to obtain a post-birth order but results vary depending on where you live.
