As a surrogate, you have to pay taxes in Florida. You are providing a service by carrying a baby and the monthly payments you receive for doing so are considered income.

One way to know for sure is if you receive a 1099 form during tax season from the third-party escrow service that distributes your payments. But just because you don’t receive a 1099 does not mean the income is tax-free.

Do Surrogates Get Maternity Leave in Florida?

Surrogates do get maternity leave in Florida. The Family Medical Leave Act (FMLA) allows you 12 weeks of unpaid leave.

Do Surrogates Get Paid if They Miscarry?

Yes, surrogates get paid if they miscarry. You will be paid for as long as you are pregnant so if the miscarriage occurs four months in, you will be paid for four months.
